第1条　この規約について

この利用規約（以下「本規約」）は、iPhone向けアプリ「Heya AI」（以下「本アプリ」）の利用条件を定めるものです。本アプリは、インターナショナルデザイン合同会社（以下「当社」）が提供します。App Storeでは、当社代表のCarlos Lastresの名前で配信しています。

本アプリをダウンロードし、または利用した時点で、本規約に同意したものとみなします。同意できない場合は、本アプリを利用せず、端末から削除してください。

第2条　Appleの使用許諾契約との関係

本アプリには、Appleの標準エンドユーザ使用許諾契約（EULA）も適用されます。本規約はそれに加えて適用されます。Appleは本規約の当事者ではなく、本アプリやそのサポートについて責任を負いません。

第3条　本アプリでできること

本アプリは、部屋の写真をもとに、日本のお店で実際に買える家具を置いたリデザインのイメージを作り、商品の価格、サイズ、お店のページへのリンクを表示します。

第4条　画像と商品情報について

  1. リデザインの画像はAIが生成したイメージです。家具の形、色、大きさ、配置、部屋の様子が、実際とまったく同じになるとは限りません。
  2. 商品の価格、サイズ、在庫などは、各お店の情報をもとに表示していますが、変わることがあります。購入の前に、必ずお店のページで確認してください。部屋の広さの推定はあくまで目安です。置けるかどうかは、実際に測って確かめてください。
  3. 当社は商品の販売者ではありません。商品の購入、配送、返品などは、それぞれのお店との間の取引になり、そのお店の条件に従います。

第5条　料金

  1. 無料のリデザインは、Apple IDごとに1回です。
  2. 「リデザイン10回」は980円の買い切りで、有効期限はありません。Appleの方針で認められる場合を除き、返金はできません。
  3. 「Heya Plus」は月額1,480円または年額9,800円の自動更新サブスクリプションで、毎月最大60回までリデザインできます。
  4. お支払いは、購入を確定したときにApple IDに請求されます。サブスクリプションは、期間が終わる24時間前までに解約しない限り自動で更新され、更新の料金は期間終了前の24時間以内に請求されます。解約や管理は、iPhoneの設定にあるApple IDのサブスクリプションから行えます。アカウントを削除しても、サブスクリプションは解約されません。

第6条　使ってはいけないこと

  1. 写真は、ご自身が撮影したものなど、使う権利のあるものだけを使ってください。
  2. 人が写っている写真は使わないでください。
  3. 法令に反する目的、他人の権利を侵害する目的、本アプリやサーバーに過度な負荷をかける目的で本アプリを使ってはいけません。

第7条　保証しないこと

本アプリは現状のまま提供します。当社は、本アプリが正確であること、誤りや不具合がないこと、特定の目的に合うこと、今後も提供され続けることを保証しません。当社は、予告なく本アプリの内容を変更し、または提供を終了することがあります。

第8条　責任の制限

  1. 当社は、本アプリを利用したこと、または利用できなかったことにより利用者に生じた損害（購入した家具が合わなかったこと、お店との取引に関する損害を含みます）について、責任を負いません。
  2. 前項にかかわらず、利用者が消費者契約法上の消費者であり、当社の過失（重大な過失を除きます）によって損害が生じた場合、当社は、現実に生じた直接かつ通常の損害に限り、1万円を上限として賠償します。
  3. 当社に故意または重大な過失がある場合、前二項は適用されません。

第9条　本規約の変更

当社は、民法の定めに従って本規約を変更することがあります。その場合は、変更後の内容と効力が生じる日を、その日より前にこのページでお知らせします。

第10条　準拠法と裁判管轄

本規約は日本法に従って解釈されます。本アプリに関する紛争は、東京地方裁判所を第一審の専属的合意管轄裁判所とします。

第11条　言語

本規約は日本語版を正本とします。英語版は参考のための翻訳です。

Terms of Use

1. About these terms

These Terms of Use (the “Terms”) set the conditions for using Heya AI for iPhone (the “App”). The App is provided by International Design LLC (“we”). On the App Store it is distributed under the name of Carlos Lastres, our representative.

By downloading or using the App, you agree to these Terms. If you do not agree, do not use the App and delete it from your device.

2. Apple’s license agreement

Apple’s Standard End User License Agreement (EULA) also applies to the App, and these Terms apply in addition to it. Apple is not a party to these Terms and is not responsible for the App or its support.

3. What the App does

From a photo of your room, the App makes an image of the room redesigned with furniture you can buy from stores in Japan, and shows each product’s price, size and a link to its store page.

4. Images and product information

  1. Redesigns are AI generated illustrations. The shape, color, size and placement of furniture, and the room itself, may not look exactly as they will in real life.
  2. Prices, sizes and stock come from each store and can change. Always check the store’s page before you buy. The room size estimate is approximate, so measure before you decide something fits.
  3. We are not the seller. Buying, delivery and returns are between you and the store, under that store’s conditions.

5. Prices

  1. The free redesign is one per Apple ID.
  2. “10 redesigns” is a one time purchase of ¥980 that never expires. It is not refundable except as Apple’s policies allow.
  3. “Heya Plus” is an auto renewing subscription at ¥1,480 a month or ¥9,800 a year, with up to 60 redesigns a month.
  4. Payment is charged to your Apple ID when you confirm the purchase. A subscription renews automatically unless you cancel at least 24 hours before the end of the current period, and the renewal is charged within the 24 hours before that period ends. You can manage or cancel it in your Apple ID subscription settings on your iPhone. Deleting your account does not cancel a subscription.

6. Acceptable use

  1. Use only photos you have the right to use, such as ones you took yourself.
  2. Do not use photos that show people.
  3. Do not use the App for anything unlawful, to infringe anyone’s rights, or to put excessive load on the App or our servers.

7. No warranty

The App is provided as is. We do not guarantee that it is accurate, free of errors or bugs, fit for any particular purpose, or that it will continue to be offered. We may change the App or stop offering it at any time without notice.

8. Limitation of liability

  1. We are not liable for any loss or damage arising from your use of, or inability to use, the App, including furniture that does not fit and anything arising from your dealings with a store.
  2. Despite paragraph 1, if you are a consumer under Japan’s Consumer Contract Act and the damage is caused by our negligence (other than gross negligence), we will compensate only direct and ordinary damage actually incurred, up to 10,000 yen.
  3. Paragraphs 1 and 2 do not apply where we acted intentionally or with gross negligence.

9. Changes to these Terms

We may change these Terms as permitted by the Civil Code of Japan. When we do, we will post the new Terms and the date they take effect on this page before that date.

10. Governing law and jurisdiction

These Terms are governed by the laws of Japan. The Tokyo District Court has exclusive jurisdiction in the first instance over any dispute about the App.
